• Modify, copy, or create derivative works based on SmartAds or its content
• Use SmartAds for any commercial purpose not expressly permitted by SaaS Cloud LLC
• Attempt to decompile or reverse engineer any software contained in SmartAds
• Remove any copyright or other proprietary notations
• Transfer SmartAds to another person or "mirror" it on any other server

2. Account Responsibilities

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party.

3. OpenAI API Integration

SmartAds allows you to connect your OpenAI API key to access certain functionality. By providing your API key, you acknowledge and agree that:

• You are responsible for any charges incurred through your OpenAI API key
• You must comply with OpenAI's terms of service
• We process but do not store your API key
• We are not responsible for any issues related to OpenAI's services

4. Intellectual Property

The SmartAds service and its original content, features, and functionality are and will remain the exclusive property of SaaS Cloud LLC and its licensors. The service is protected by copyright, trademark, and other laws.

Content generated through the service using your inputs belongs to you, but we do not claim ownership of content you import or generate using third-party services (such as OpenAI).

5. User Content

Our service allows you to generate and create content. You are solely responsible for the content you create, import, or generate using our service, including its legality, reliability, and appropriateness.

By creating content through our service, you represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to display or process your content
• Your content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity

6. Prohibited Uses

You may not use SmartAds for any purpose that is prohibited by these Terms or law. You may not use the service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the service.

You may not use SmartAds to:

• Create deceptive or misleading content
• Generate or distribute spam, malware, or illegal content
• Infringe on the intellectual property rights of others
• Harass, abuse, or harm another person
• Violate any applicable laws or regulations

7. Payments and Subscriptions

SmartAds offers a lifetime deal at a one-time payment. By purchasing our lifetime deal, you agree to pay the amount indicated at checkout. All payments are processed through secure third-party payment processors.

While we offer lifetime access to our service, this is subject to our fair use policy and does not guarantee that the service will exist indefinitely. We reserve the right to make changes to our service or discontinue it with reasonable notice.

8. Limitation of Liability

In no event shall SaaS Cloud LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
